ScorX Terms of Service

Quick Summary: By using ScorX, you agree to these terms. Subscriptions auto-renew unless canceled. You own your data. We provide the app "as is" and reserve the right to modify features.
1. Acceptance of Terms
By downloading, installing, or using the ScorX mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and ScorX ("we," "us," or "our").
2. Eligibility
You must be at least 13 years of age to use ScorX. If you are under 18, you must have permission from a parent or guardian to use the App and make purchases.
By using ScorX, you represent and warrant that:
- You meet the age requirements
- You have the legal capacity to enter into these Terms
- You will comply with all applicable laws and regulations
3. License to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install ScorX on your iOS device(s)
- Access and use the App for personal, non-commercial purposes
You may NOT:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or attempt to extract source code
- Use the App for any illegal or unauthorized purpose
- Remove or alter any copyright, trademark, or proprietary notices
- Use the App to violate any laws or third-party rights
4. Subscriptions and Payments
4.1 Subscription Tiers
ScorX offers multiple subscription tiers:
- Free Tier: No payment required, limited features
- Family Tier: $4.99/month or $49.99/year with 30-day free trial
- Coach Tier: Coming in v1.1 (pricing TBA)
- Club Tier: Coming in v1.1 (pricing TBA)
4.2 Free Trial
Family tier subscriptions include a 30-day free trial for new subscribers:
- You will not be charged during the trial period
- You can cancel anytime during the trial without charge
- If you do not cancel at least 24 hours before the trial ends, you will be automatically charged
- Any unused portion of the trial is forfeited when you purchase a subscription
4.3 Auto-Renewal
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period:
- Your Apple ID account will be charged for renewal within 24 hours before the current period ends
- You will be charged at the subscription rate in effect at the time of renewal
- The renewal term is the same as your original subscription period (monthly or yearly)
4.4 Managing Subscriptions
You can manage and cancel subscriptions through:
- iPhone Settings → [Your Name] → Subscriptions
- ScorX App → Settings → Subscriptions → Manage
Cancellation takes effect at the end of the current billing period. You will retain access to paid features until then.
4.5 Payment Processing
All payments are processed through Apple's App Store. We do not store or process payment information directly. By subscribing, you agree to Apple's terms and conditions for in-app purchases.
4.6 Refunds
Refunds are handled by Apple according to their policies:
- You may request a refund through Apple within 14 days of purchase in some jurisdictions
- Contact Apple Support to request refunds
- We do not control or process refunds directly
5. User Content and Data
5.1 Your Content
You retain all ownership rights to the content you create in ScorX, including:
- Team names and configurations
- Player information and statistics
- Game data and scores
- Photos, logos, and other media
5.2 License to Use Your Content
By using ScorX, you grant us a limited license to:
- Store your content on our servers (CloudKit for Family tier and above)
- Process and display your content within the App
- Back up your content for service reliability
We will NOT:
- Share your content with third parties without your consent
- Use your content for advertising or marketing
- Sell or monetize your personal data
5.3 Data Backup and Loss
While we implement CloudKit sync for Family tier subscribers, you are responsible for maintaining your own backups. We are not liable for any loss of data due to:
- Technical failures or service interruptions
- Your device loss, damage, or malfunction
- Subscription cancellation or account termination
5.4 Prohibited Content
You may not create or upload content that:
- Is illegal, harmful, threatening, or abusive
- Infringes on intellectual property rights
- Contains malware or malicious code
- Violates privacy or publicity rights of others
6. Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Key privacy commitments:
- No third-party data sharing or selling
- No third-party analytics or tracking
- End-to-end encryption for CloudKit sync
- You can export or delete your data at any time
7. Acceptable Use
You agree to use ScorX only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the App in any way that violates applicable laws or regulations
- Impersonate any person or entity
- Interfere with or disrupt the App's functionality
- Attempt to gain unauthorized access to any systems or data
- Use automated means to access the App without permission
- Collect or harvest any user information
8. Intellectual Property
8.1 Our Rights
ScorX and all related trademarks, logos, and service marks are owned by us. The App's design, functionality, and content are protected by copyright, trademark, and other intellectual property laws.
8.2 Feedback
If you provide feedback, suggestions, or ideas about ScorX, you grant us the right to use that feedback without compensation or attribution.
9. Disclaimers and Warranties
9.1 "As Is" Provision
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the App will be error-free or uninterrupted
- Warranties regarding accuracy, reliability, or completeness
9.2 Use at Your Own Risk
Your use of ScorX is at your sole risk. We do not warrant that:
- The App will meet your requirements
- The App will be available at all times
- Any errors will be corrected
- The App is free of viruses or harmful components
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, or consequential damages
- Loss of profits, data, or use
- Service interruptions or data loss
- Any damages arising from your use of or inability to use the App
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS, OR $50, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold harmless ScorX, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Your content or data
12. Modifications to the App and Terms
12.1 App Modifications
We reserve the right to:
- Modify, suspend, or discontinue any part of the App
- Change features, functionality, or pricing
- Release updates and require users to update
We are not liable for any modifications or discontinuations.
12.2 Changes to Terms
We may update these Terms from time to time:
- We will notify you of material changes via the App or email
- Continued use of the App after changes constitutes acceptance
- If you do not agree to changes, you must stop using the App
13. Termination
13.1 Termination by You
You may terminate your use of ScorX at any time by:
- Deleting the App from your device
- Canceling your subscription (if applicable)
13.2 Termination by Us
We may terminate or suspend your access immediately, without notice, if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Abuse the App or harm other users
13.3 Effect of Termination
Upon termination:
- Your right to use the App immediately ceases
- Your local data remains on your device until you delete the App
- CloudKit data may be retained for 30 days, then deleted
- Sections of these Terms that by nature should survive will remain in effect
14. Third-Party Services
ScorX integrates with Apple services:
- Apple iCloud (CloudKit): For cloud synchronization
- Apple App Store: For distribution and payment processing
- Apple StoreKit: For subscription management
Your use of these services is subject to Apple's terms and conditions. We are not responsible for any third-party services.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.
15.2 Dispute Resolution

16. Apple-Specific Terms
If you download ScorX from the Apple App Store, you acknowledge that:
- These Terms are between you and ScorX, not Apple

- Apple is a third-party beneficiary of these Terms and may enforce them
17. General Provisions
17.1 Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement between you and ScorX regarding use of the App.
17.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
17.3 Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
17.4 Assignment
You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
